MinglMe Terms of Service

Welcome to MinglMe!
MinglMe is a digital platform that brokers tickets to activities and enables interaction between users, with the aim of creating genuine and meaningful connections.
By creating an account and using our service, you accept these terms of service. Please read them carefully before you begin.

1. General
MinglMe's role
MinglMe provides a digital platform for brokering tickets to activities that are arranged by independent third-party providers ("Hosts"). MinglMe does not act as the organiser or seller of activities, but solely as an intermediary in the name of and on behalf of the Host.
These terms of service ("the Terms") apply between you and us and govern your use of the Service.
"The Service" means the digital services provided by Mingel Me AB, company reg. no. 559510-0610 ("MinglMe", "we", "us") via the website www.minglme.com, the web application and the mobile application MinglMe (available for download via the App Store and Google Play), as well as the brokering of tickets to activities ("Activities") that are arranged and provided by independent third-party providers ("Hosts").
MinglMe is not a party to the agreement between the Participant and the Host regarding the Activity itself, but provides only the platform, booking system and payment intermediation.
By "you" we mean you who have a user account ("User"), are a paying user ("Member"), have purchased a ticket in order to take part in an Activity, as well as you who take part in an Activity ("Participant") and thereby use the Service.
By becoming a User or Member and using the Service, this agreement enters into force, you accept these Terms and confirm that you have read MinglMe's privacy policy. Processing of personal data takes place in accordance with MinglMe's privacy policy as in force from time to time.
MinglMe does not handle complaints, compensation claims or disputes relating to the content, quality or performance of an Activity.

2. Acceptance of the Terms
By creating an account with MinglMe and beginning to use the Service, you accept these Terms.
Creating an account and viewing the range of Activities is free of charge. To book a ticket to an Activity and gain access to all functions of the Service, a subscription is required in accordance with section 5. You actively choose yourself which subscription you wish to take out, and the subscription's length, price and any free trial period are clearly shown in the app and on the web before you confirm your choice.
If you wish to purchase a ticket to an Activity before you have taken out a subscription, you will, in connection with the booking, be informed that the purchase requires a subscription, and you must actively approve that the subscription is taken out before payment is made.

3. User account

3.1 Eligibility
To create a user account and use the Service you must: be at least 18 years old, have the right to enter into agreements under Swedish law, provide correct information at registration, provide a valid payment method, and accept these terms and our privacy policy.

3.2 Responsibility
You are responsible for keeping your login details confidential and for all activity that takes place via your account. MinglMe has no ability to technically verify the identity of the person registering for the Service and accepts no responsibility for use by minors that is not detected in time. Providing false information may lead to immediate suspension. The User is responsible for being able, on request, to prove their age with a valid ID document.

3.3 Communication and information responsibility
MinglMe communicates with users via the e-mail address that the user provided when registering the account. The user is responsible for ensuring that the provided e-mail address is correct, active and regularly checked, and for ensuring that messages from MinglMe can be received and are not blocked or sorted as spam.
Information relating to bookings, confirmations, changes, cancelled activities or other essential information is deemed to have reached the user when it has been sent to the registered e-mail address.
MinglMe is not responsible for consequences arising from the user not having read such information. Failure to read e-mail, technical problems on the user's side or inadequate checking of the inbox or spam folder do not constitute grounds for a refund, rebooking or other compensation.

3.4 Personal use
The account is personal and may not be shared with third parties. The Service may only be used for private and non-commercial purposes. You are responsible for all activity on your account and must protect your login details.
The profile picture must depict you as a person. It is not permitted to use a profile picture showing someone else or that does not clearly depict the account holder.

3.5 Prohibited use and suspension
The Service may not be used for unlawful purposes or in a manner that may be perceived as offensive or abusive. See also section 8 for rules on content and conduct in the Service and on reporting.
MinglMe has the right to suspend or terminate your account, in whole or in part, if you breach these Terms or if other grounds otherwise exist as described in MinglMe's privacy policy under the section "Deletion of account" (e.g. inappropriate content in the profile picture or profile text, a profile picture that does not depict the account holder themselves, flagging by other users or Hosts for inappropriate behaviour, false registration details, or that the user is under 18 years old).

3.6 Deletion of your own account
You can delete your account at any time directly in the Service via Profile → Settings → Account, or by contacting support@minglme.se. Further information on deletion and what happens to your personal data is set out in MinglMe's privacy policy.

4. The Service
The Service consists of a digital platform where users can:
discover activities
book and pay for tickets
interact with other users
All Activities are arranged by independent Hosts. MinglMe acts solely as an intermediary for booking and payment in the name of and on behalf of the Host and is not the organiser, provider or performer of any Activity. The agreement to take part in an Activity is entered into directly between the Participant and the respective Host. The brokering of bookings may be carried out applying selection criteria in accordance with section 4.1.

4.1 The platform's selection and grouping
In order to create meaningful, safe and relevant encounters, MinglMe applies selection criteria when brokering bookings to Activities. The selection criteria may relate to, for example, age range, group size and the composition of booked participants.
The purpose is to give participants the conditions to meet others in a similar life stage and context. The selection and grouping of bookings relate solely to how bookings are brokered via the platform and do not mean that MinglMe arranges, provides or is responsible for the content, performance or quality of the Activity. Selection and grouping take place automatically and/or administratively within the framework of the Service and form part of the platform's functionality, not of the Activity.
MinglMe does not guarantee any particular composition of participants and reserves the right to adjust the grouping to the extent reasonably required to maintain the quality and function of the Service.

5. Payment terms and subscription
The Service includes subscriptions that give access to booking Activities and to all functions of the Service. Subscriptions are offered in different lengths and at different prices. You actively choose yourself which subscription you wish to take out. The subscription's length, price and any free trial period are shown in the app and on the web before you confirm your choice.
A subscription renews automatically at the end of the period with a new period of the same length, at the price applicable at that time, until you choose to cancel it. By taking out a subscription, you confirm that you are aware that it renews automatically and that payment is made in accordance with the choice you have made.
You can cancel your subscription at any time. Cancelling means that the subscription is not renewed after the end of the current period. A period that has already been paid for runs until the end of that period and is not refunded, subject to your right of withdrawal under section 6. If a free trial period is included and you do not cancel before it ends, you accept that the subscription converts into a paid subscription in accordance with the choice you have made.
Subscribers who, at the time these terms enter into force, have an ongoing monthly subscription retain their monthly subscription on unchanged terms until they themselves choose to change or cancel it.
Payment is made in advance for each period via the payment method you have selected. The payment is handled by a third-party provider. Non-payment may lead to your account being paused or terminated.

5.1 Ticket purchases and subscription
Purchasing tickets to an Activity is only available to subscribers. If you wish to purchase a ticket without having an active subscription, you will be informed that the purchase requires a subscription, be able to choose a subscription and see its price, and actively approve that the subscription is taken out and charged at the price applicable at the time it is taken out.
By proceeding with the ticket purchase, you consent to your account being immediately upgraded to paying membership.

5.2 Payment and VAT
When purchasing a ticket to an Activity, payment is made via MinglMe as payment intermediary. The Host is the seller of the Activity and is responsible for pricing, the applicable VAT rate and the reporting of VAT. MinglMe collects payment from the Participant on behalf of the Host and forwards the ticket revenue to the Host in accordance with the applicable agreement between MinglMe and the Host.

6. Right of withdrawal
For the subscription, a 14-day right of withdrawal applies from the day you took out the subscription, in accordance with the Act (2005:59) on distance contracts and off-premises contracts.
You can exercise your right of withdrawal in the Service, where the agreement was concluded (in the app or on the web), via the withdrawal function (”withdrawal button”) that is available throughout the withdrawal period, or by contacting us. You receive a confirmation once you have exercised the right of withdrawal. You can also cancel your subscription at any time under ”My Profile”.
Exercising the right of withdrawal in respect of the subscription does not affect ticket purchases that have already been made. Special terms apply to tickets to Activities in accordance with section 7.2.

7. Activities and hosts
Activities are arranged and provided by independent Hosts. The Host is fully responsible for the Activity's content, performance, safety, quality, permits, staff, equipment and for compliance with applicable laws and rules. MinglMe is not responsible for the performance of the Activity and is not a party to the relationship between the Participant and the Host. The Host is responsible for the performance of the Activity regardless of how bookings have been grouped or brokered via the platform.

7.1 Minimum number of participants
For an Activity to be held, a minimum number of participants may be required. If the minimum number of participants for a particular Activity is not reached, the Host reserves the right to cancel the Activity and MinglMe carries out a refund of the amount you have paid using the same payment method that was used for the purchase.
When the minimum number of participants has been reached by the final registration date and the Activity is subsequently held, the booking is binding. Cancellation that takes place after the final registration date, as well as failure to attend the Activity ("no-show"), does not entitle you to a refund.

7.2 Ticket purchases and right of withdrawal
Payment is made via the specified payment methods and includes VAT, unless otherwise stated.
Under the Act (2005:59) on distance contracts, no right of withdrawal applies to tickets to activities with a specific date or a fixed period of time. Ticket purchases are therefore fundamentally binding, unless the Host expressly offers a refund.
MinglMe acts solely as an intermediary for the ticket purchase and is not the seller of the Activity. Any terms for refund, rebooking or cancellation are determined by the Host in accordance with applicable law.
If a refund is offered by the Host and the applicable conditions are met, the refund is made via the same payment method that was used for the purchase, within thirty (30) days from receipt of the request, adjusted for any external transaction fees that are not refunded by the payment service provider.
MinglMe does not compensate participants who are unable to attend due to illness, medical reasons or other personal circumstances.
MinglMe follows and enforces the Host's refund, rebooking and cancellation terms, but makes no independent decisions on compensation beyond what follows from mandatory law or an express instruction from the Host.
Complaints, grievances or refund claims relating to the Activity's content, quality, performance, deviation from the described arrangement or other circumstances attributable to the Activity itself must be directed to the Host. MinglMe does not handle complaints or refund claims based on alleged lack of quality or deviation in the Activity.

7.3 Changes to an Activity
If the Host, or MinglMe on behalf of the Host, needs to change the time, date, place or other essential aspect of the Activity before it begins, the Participant will be informed by e-mail as soon as possible.


The Participant has the right to:
take part in the Activity at the new time and place, or
decline to take part and, where applicable, request a refund of the amount paid
Any refund is made without extra charges within thirty (30) days of the Participant's request.
MinglMe shall not be held liable for changes to an Activity that are due to force majeure or decisions made by the Host.

7.4 Cancellation of an Activity
If the Host, or MinglMe on behalf of the Host, is forced to cancel an Activity, the Participant will be informed by e-mail as soon as possible. In the event of cancellation, the Participant is entitled to a refund of the full amount paid, where applicable.
The refund is made without extra charges within thirty (30) days from when information about the cancellation has been communicated.

7.5 Allergies, special diets and participant responsibility
For activities where food or drink is included, the participant is responsible for reporting any allergies, food intolerances or need for vegetarian or vegan food no later than 48 hours before the start of the activity.
This responsibility rests with the participant regardless of whether a reminder, request or information has been provided by MinglMe or the host.
Special diets that have not been reported within the stated time cannot be accommodated. If, as a result of missing or late reporting, the participant is unable to take part in or make use of the activity in whole or in part, the right to use the ticket lapses.
No refund, rebooking or other compensation is provided.

7.6 Health requirements and responsibility when taking part
Participation is at your own risk. You are responsible for assessing whether an activity is suitable for you and that you are sufficiently healthy to take part without risk to yourself or others.
If an accident or incident occurs due to lack of attention or participation despite an unsuitable state of health, MinglMe is not responsible. Where necessary, MinglMe or the Host may require you to sign a waiver of liability.

7.7 Code of conduct
Participants must follow the code of conduct in order to create a safe and positive environment:
Treat others with respect and kindness.
Follow the Host's instructions and report inappropriate behaviour.
Act responsibly and respect your own and others' boundaries, including with regard to alcohol consumption.

7.8 Responsibility and safety
Participants undertake to:
Follow the Host's instructions, safety guidelines and rules.
Respect the code of conduct and these Terms.
MinglMe may suspend or terminate an account/membership in the event of a breach of the rules.
MinglMe is not responsible for damage arising due to:
Other participants' behaviour or negligence.
Breach of the code of conduct.
Force majeure or unforeseen events beyond MinglMe's control.

7.9 Exclusion
Participants who breach the rules may receive:
A warning for minor violations.
Exclusion for serious violations or risk to safety and well-being.
Examples of serious violations: intoxicated behaviour, risk to health, harassment or inappropriate conduct.
Consequences:
No compensation in the event of exclusion.
May lead to loss of the right to take part in future activities.
In the event of serious violations, MinglMe and the Host may report the matter to the authorities.

7.10 Travel as an Activity
These terms of service do not apply to travel services advertised in the Service. Such services will be subject to an agreement concluded directly between the Member or User and the travel organiser. Please therefore refer directly to the general terms of the relevant Host.

8. Community and moderation
MinglMe wants the Service to be a safe place for encounters, both digitally and at Activities. These rules apply to all interaction between users in the Service, including profile content, messages and other communication.

8.1 Prohibited content and conduct
The following is not permitted in the Service:
Harassment, threats, hateful language or discrimination
Sexual, pornographic or otherwise inappropriate content
Spam, fraud, fake profiles or marketing of third-party services
Content that breaches Swedish law or the rights of others
A profile picture or profile text that does not meet the requirements of section 3.4

8.2 Reporting and blocking
Users can report inappropriate content, messages or other users directly in the Service via the built-in reporting function. Users can also block other users to prevent further contact.
Reports can also be sent by e-mail to hello@minglme.se.

8.3 Handling of reports
MinglMe reviews incoming reports manually, normally within 24–48 hours of the report being received. Depending on the nature and severity of the violation, MinglMe may take measures such as:
A warning to the user
Removal of inappropriate content
Temporary suspension of the account
Permanent suspension of the account in accordance with section 3.5
In the event of suspected crime, MinglMe may contact the police or another competent authority and disclose relevant information in accordance with applicable law and MinglMe's privacy policy.
MinglMe does not guarantee any particular outcome of a report but strives to handle all matters promptly and fairly.

9. Rights
All intellectual property rights in the Service, including technical solutions, design, source code, trademarks and content, belong to MinglMe or our licensors. You may not copy, modify or share material covered by these rights unless the Service expressly permits it. MinglMe is a registered trademark belonging to Mingel Me AB.
Content and information that you register in the Service belong to you. MinglMe does not have ownership of user-generated content, but only processes it in accordance with the privacy policy.

10. Our responsibility
The Service is normally available around the clock, but we cannot guarantee uninterrupted access. Availability may be affected by external factors, system maintenance or updates.
We reserve the right to change, develop or discontinue all or part of the Service without your approval. You cannot claim compensation for changes or for the Service not functioning flawlessly.
The Service may contain links to third-party websites or apps, and we are not responsible for their content.
For Activities, the respective Host is responsible for the offering and quality regardless of how booking, grouping or communication has taken place via the Service. MinglMe does not guarantee access to specific Hosts or Activities.

11. Limitation of liability
MinglMe is not responsible for the quality, safety, performance or outcome of Activities, as these are carried out by the respective Host.
MinglMe's responsibility is limited to providing the digital Service, including the booking system, subscription functions and payment intermediation.
MinglMe is not responsible for damage, losses or claims arising in connection with an Activity, other than to the extent prescribed by mandatory law.

12. Changes to the Service
MinglMe reserves the right to update, change or temporarily suspend the Service at any time. In the event of material changes affecting your subscription, you will be informed by e-mail or in the app. Changes to functions of the service (e.g. removed functions) do not entitle you to compensation.

12.1 Changes in price
The price applicable when you take out or renew a subscription is shown in the app and on the web and applies for the period in question. If MinglMe changes the price of an ongoing subscription, we will notify you by e-mail at least 30 days before the change takes effect, and you have the right to cancel the subscription free of charge before the change comes into effect.

13. Changes to the Terms
MinglMe may update these Terms from time to time. In the event of material changes affecting the User's rights or obligations, MinglMe will inform the User in advance by e-mail and/or through clear information in the Service. For minor changes or clarifications, the Terms are updated on the website with a new date of last update stated. The User is responsible for keeping informed of the applicable Terms. The Terms published on the website from time to time constitute the current version. By continuing to use the Service after updated Terms have entered into force, the User accepts the changes.

14. Applicable law and dispute resolution
Swedish law shall apply to these Terms. Any dispute arising in connection with the Service shall in the first instance be resolved through dialogue between the parties. If the dispute cannot be resolved in this way, it may be tried by a Swedish general court.
